4. How Your Personal Data is Collected

4.1 Rent2buycarz use different methods to collect data from and about you:

4.1.1 You may give us your Identity, Contact, and Financial Data through direct interactions. For example, by filling in forms or by corresponding with us by post, phone, email, or otherwise. This includes Personal Data you provide when you:

4.1.1.1 Apply or make an enquiry for our products or services, including when you provide proof of identity such as your driving licence.

4.1.1.2 Make a purchase or use our services.

4.1.1.3 Create a user account on our website.

4.1.1.4 Subscribe to our service, mailing list, or publications.

4.1.1.5 Request Marketing to be sent to you.

4.1.1.6 Contact us via any method.

4.1.1.7 Give your consent to Open Banking during your application on our website.

4.1.2 We may collect Personal Data through automated technologies and interactions. As you interact with our website, we will automatically collect Technical Data about your equipment, browsing actions, and patterns. This Personal Data is collected by using cookies, server logs, and other similar technologies. We may also receive Technical Data about you if you visit other websites employing our cookies.

4.1.3 We will receive Personal Data about you from various third parties and public sources, as set out below:

4.1.3.1 Contact, Financial, and Transaction Data from providers of technical, payment, and delivery services, such as, but not limited to, Stripe.

4.1.3.2 Open Banking Data from your bank, provided to us through our Open Banking provider, Credit Canary, only after you have given your consent and authorised the connection with your bank.

4.2 For the purposes of how we collect or use your data, reference to the EU or EEA includes a reference to the United Kingdom.

5. Open Banking, Income Assessment and Identity Verification

5.1 What Open Banking is. Open Banking is a UK-regulated way for you to securely share information from your bank account with a business you choose. As part of our application process, we ask you to connect your bank account so that we can verify your identity and check that the agreement is affordable for you.

5.2 What you are agreeing to. When you give your Open Banking consent, you are agreeing to two things only:

5.2.1 Read-only access to your account information. This allows us to view your account details, balances and historic transactions. The access is read-only. We cannot make payments, move money, set up payees or Direct Debits, or change anything on your account through Open Banking.

5.2.2 Identity validation. This allows us to check that the name of the bank account holder matches the name you gave us in your application. As part of your application, we will also ask you for further proof of identity, usually your driving licence.

5.3 How the connection works.

5.3.1 You give your consent on our website during your application. We will show you which information we are asking for and why before you agree.

5.3.2 You are then taken to your own bank’s app or website to log in and authorise the connection. You log in directly with your bank. We never see, receive or store your online banking username, password or security codes.

5.3.3 Our Open Banking provider, Credit Canary, connects to your bank using regulated Open Banking technology and passes your account information to us. Credit Canary acts on our behalf for this purpose and is not permitted to use your information for its own purposes.

5.4 How long the access lasts. We use your consent to retrieve your account information at the time of your application. We will not continue to access your bank account after that unless we ask you to connect it again and you agree. You can also cancel the connection at any time through your bank.

5.5 How we use your Open Banking Data. We use it only to:

5.5.1 check that the name on your bank account matches the name on your application;

5.5.2 calculate your average monthly income over the most recent 3 months of transactions. We count regular income such as salary or wages, pensions and regular benefits;

5.5.3 decide whether your application meets our minimum income requirement (currently £1,500 per month); and

5.5.4 help prevent fraud, and keep a record of how your application was assessed.

We do not use your Open Banking Data for Marketing, we do not sell it, and we do not use it to make decisions about anything other than your application.

5.6 How decisions are made. Our system uses your Open Banking Data to check your name and calculate your income. If your name matches and your income meets our minimum requirement, your application can be approved automatically. We never decline an application automatically. If our system cannot validate your identity or confirm your income, your application is referred to a member of our team for manual review. They may ask you for further information or documents, such as bank statements, payslips or proof of benefits. Any decision to decline an application is made by a member of our team.

5.6.1 If you disagree with a decision, you can give us your point of view and any further information, and ask for the decision to be looked at again, by contacting our DPO using the details in clause 2.2.

5.7 Our lawful basis. We access your bank account information only with your consent. We use the information to take steps at your request before entering into an agreement with you (Performance of a Contract), and to assess your application as described in clause 5.6. We keep a record of the assessment and your consent for our Legitimate Interests (to prevent fraud and to defend any legal claims) and to Comply with a Legal Obligation.

5.8 You do not have to use Open Banking. Giving your Open Banking consent is your choice. If you do not want to connect your bank account, please contact us to discuss whether another way of applying is available.

5.9 Withdrawing your consent. You can withdraw your Open Banking consent at any time by contacting our DPO or through your bank. Once you withdraw it, we will not retrieve any further information from your account. Withdrawing consent does not affect the lawfulness of anything we did before you withdrew it. We may keep the information we have already received, and the record of your assessment, for the periods set out in clause 13, where we have another lawful basis to do so (for example, to administer your agreement, to prevent fraud or to defend a legal claim).

6.1 Our website may include links to third-party websites, plug-ins, and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you.

6.2 We do not control these third-party websites and are not responsible for their privacy statements. When you leave our website, we encourage you to read the privacy policy of every website you visit. When you log in to your bank to authorise an Open Banking connection, your bank’s own privacy policy also applies.

7. Purposes for Which We Will Use Your Personal Data

7.1 Rent2buycarz will only use your Personal Data when the law allows us to. Most commonly we will use your Personal Data in the following circumstances:

We always consider your rights and balance any potential impact on you (both positive and negative) before we process your Personal Data for Legitimate Interests. We do not use your Personal Data for activities where our interests are overridden by the impact on you unless we have your consent or are otherwise required or permitted to by law. You can contact us to obtain further information about how we assess our Legitimate Interests against any potential impact on you in respect of specific activities.

7.1.3 Where it is necessary for compliance with a legal obligation that we are subject to (“Comply with a Legal Obligation”).

7.1.6 We may use your Identity, Contact, Marketing and Communications, and Profile Data to add you to our mailing list.

7.2 Where we need to collect Personal Data by law or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you, and as a result, Rent2buycarz may be unable to provide you with a product or service. In this case, we may have to cancel any product or service you have with us, but we will notify you if this is the case at the time.

7.3 The table below sets out a description of all the ways Rent2buycarz plan to use your Personal Data and which of the legal bases we rely on to do so. They will only process your Personal Data on our instructions and are subject to a duty of confidentiality. Access to Open Banking Data is restricted to the systems and staff who need it to assess and administer applications.

12.3 Open Banking connections are made using secure, regulated technology. You authorise the connection directly with your bank, and we never receive your online banking login details.

12.4 We have put in place procedures to deal with any suspected Personal Data breach and will notify you and any applicable regulator of any breach where we are legally required to do so.

13. Data Retention

13.5 We keep Open Banking Data, Affordability Data and Consent Data as follows:

13.5.1 If your application is approved, we keep your Open Banking transaction data for the length of your agreement and for 3 years after it ends. We keep your income assessment, the record of the decision and your Consent Data for the length of your agreement and for 6 years after it ends, with the rest of your customer file, so that we can show how your application was assessed and deal with any complaint or legal claim.

13.5.2 If your application is not approved or is withdrawn, we keep this information for 12 months from the date of the decision, so that we can deal with any request to look at the decision again and to help prevent fraud. After that, we will delete it.

13.6 In some circumstances, you can ask us to delete your data. See clause 14 for further information in relation to your legal rights.

13.7 In some circumstances, we will anonymise your Personal Data (so that it can no longer be associated with you) for research or statistical purposes. In which case, we may use this information indefinitely without further notice to you.

14.1 Under certain circumstances, you have rights under data protection laws in relation to your Personal Data, specifically:

14.1.1 You have the right to request access to your Personal Data (commonly known as a “Data Subject Access Request”). This enables you to receive a copy of the Personal Data we hold about you and to check that we are lawfully processing it.

14.1.2 You have the right to request correction of your Personal Data. This enables you to have corrected any incomplete or inaccurate data we hold about you, though we may need to verify the accuracy of the new data you provide to us.

14.1.3 You have the right to request erasure of your Personal Data. This enables you to ask us to delete or remove any Personal Data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your Personal Data where you have successfully exercised your right to object to processing, where we may have processed your information unlawfully, or where we are required to erase your Personal Data to comply with local law. Please note that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you at the time of your request.

14.1.4 You have the right to object to processing of your Personal Data where we are relying on a Legitimate Interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your Personal Data for direct Marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

14.1.5 You have the right to request restriction of processing your Personal Data. This enables you to ask us to suspend the processing of your Personal Data in the following scenarios:

14.1.5.1 If you want us to establish the data’s accuracy.

14.1.5.2 Where our use of the data is unlawful, but you do not want us to erase it.

14.1.5.3 Where you need us to hold the data, even if we no longer require it, as you need it to establish, exercise, or defend legal claims.

14.1.5.4 You have objected to our use of your data, but we need to verify whether we have overriding legitimate grounds to use it.

14.1.6 You have the right to request transfer of your Personal Data to you or a third party. We will provide to you or a third party you have chosen, your Personal Data in a structured, commonly used, machine-readable format. Please note, this right only applies to automated information which you initially provided consent for us to use, or where we used the information to perform a contract with you.

14.1.7 You have the right to withdraw consent where we are relying on consent to process your Personal Data, including your Open Banking consent (see clause 5.9). However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain product or services to you. We will advise you if this is the case, at the time you withdraw your consent.

14.1.8 You have the right not to be subject to a decision based solely on automated processing which has a significant effect on you. We never decline an application by automated means alone. See clause 5.6 for how decisions are made and how to ask for a decision to be looked at again.

14.2 If you wish to exercise any of the rights set out above, please contact our DPO.

15. Requesting Access to Your Personal Data

15.1 You will not have to pay a fee to access your Personal Data or to exercise any of the other rights. However, Rent2buycarz may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

15.2 Rent2buycarz may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Data, or to exercise any of your other rights. This is a security measure to ensure that Personal Data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

15.3 We try to respond to all legitimate requests within one month. However, it could take us longer if your request is particularly complex or you have made several requests. In this case, we will notify you and try to keep you updated.

16. General

16.1 If any provision or part provision of this Privacy Policy becomes invalid, illegal, or unenforceable, this shall not affect the validity and enforceability of the rest of this policy. If it comes to the attention of either party that any provision or part provision of this Privacy Policy is invalid, illegal, or unenforceable, the parties shall negotiate in good faith to amend such provision so that, as amended, it is legal, valid, and enforceable.
